Terms and Conditions of Use and Sale

Article 1 — Purpose of the service

These Terms and Conditions govern access to and use of the software platform and the telephone services provided by an artificial intelligence conversational agent, marketed under the PermanenceAI brand by SINAY STRATEGIC LLC.

The service allows businesses to delegate inbound call answering, caller qualification and synchronised appointment booking, 24 hours a day, 7 days a week.

Article 2 — Terms of the 14-day free trial

When first subscribing to a plan, each new customer receives a free trial period of fourteen (14) consecutive calendar days, including 30 minutes of calls:

• Payment method: A bank card is required to activate the trial. No amount is charged during the 14-day trial. All prices are stated excluding tax.
• Usage cap: Calls are limited to 30 minutes during the trial; beyond that, they are suspended until the subscription starts.
• End of the trial: At the end of the 14 days, the subscription to the chosen plan starts and the first monthly payment is taken, unless the customer has cancelled it before that date from their customer area, in which case nothing is charged.
• Fair use: The free trial is limited to one per legal entity / registration number.

Article 3 — Right of withdrawal and 14-day Peace of Mind Guarantee

Although contracts between professionals do not legally benefit from the consumer right of withdrawal, PermanenceAI offers, as a commercial gesture, a full refund guarantee within 14 days of the first paid subscription.

On simple notification by email to contact@permanenceia.com within 14 days of the first payment, the full monthly fee is refunded with no reason required.

Article 4 — Billing, prices and termination

Prices are stated in US dollars (USD), excluding tax. Applicable taxes are calculated automatically at payment based on the customer’s country and status (individual or business, with or without a VAT number). Payments are made monthly through our secure payment provider Stripe; the subscription renews automatically each month.

The customer may cancel their subscription at any time and without notice from their dashboard at app.permanenceia.com. Cancellation takes effect at the end of the monthly period already paid for. The customer may change plan at any time and add minutes with a credit top-up; credit purchased never expires and is used to pay for minutes beyond the plan, at the extra-minute rate shown on the Pricing page.

Article 5 — Liability and nature of the obligation

PermanenceAI is bound by an obligation of means (best-efforts obligation) regarding the availability and technical processing of call traffic. The user acknowledges that generative artificial intelligence and speech synthesis models may occasionally produce approximate or inaccurate answers.

Under no circumstances shall PermanenceAI be liable for indirect operating losses, loss of profit or commercial damage. In all cases, the maximum compensation is expressly limited to the amount, excluding tax, paid by the customer during the month preceding the event giving rise to the claim.

Article 6 — Prohibited uses and suspension

The following are strictly prohibited: unsolicited telemarketing campaigns (abusive voice spam), fraudulent activities, and defamatory, discriminatory or unlawful statements. If abusive use is found, PermanenceAI reserves the right to suspend access to the dedicated line without compensation.

Article 7 — Governing law and jurisdiction

These Terms and Conditions are governed by French law. Any dispute relating to their interpretation or performance falls under the exclusive jurisdiction of the Commercial Court of Paris (Tribunal de Commerce de Paris).
